Why is having a gun on the passenger seat considered concealed? It wasn't on his person, and isn't he allowed to keep a gun in the car under the general "peaceable journey" or whatever it's called, theory?

What's really going on here?

In the past, the state legislature passed CCW by 2/3 initially, but two or three dems in one of the chambers always flipflopsed to uphold the gov's veto? Maybe they'll think twice this time if enough people make this case an issue. It'll be interesting to see how it plays out.

We REALLY need a few of these cases here in Illinois. I moved here a month ago, and I'm seriously considering moving to NW Indiana after grad school over this issue.

Doug, he probably had it laying on the seat or got conned into telling the cops it was on the seat without knowing the law or previous court cases. If I was in his situation (knowing the law, I would have placed it on the dash saying "Yes, it was there." Some court case a few years ago determined that a pistol on the front passenger seat is concealed. Open carry is legal in WI (though you'll probably get harrassed anywhere south of I-94), but has to be on the dash.
