Right to Discriminate?
If it were me, I would have emphasized that the reason that the Southern states had passed their laws mandating discrimination against blacks was because the businesses weren't doing it on their own.

He missed a point that would have made his case stronger. Let people exclude classes of people. Go right ahead. Make them publicize it. "No [class] allowed" signs will result in conscientious businesses and individuals refusing to do business with them.
By making their bigotry public, the market would have greater capability to correct what it sees as injustices in behavior
